This course will provide an in-depth look at the specificities of contracts for digital products or services.
The course will look at these contracts from a EU law/French law perspective. Starting with a reminder of essential principles of contract law throughout the contract life-cycle, the course will then focus on understanding the specificities of those contracts, looking at model clauses and industry standards where available in order to better understand risk allocation, liabilities and market practices under those contracts.
We will look at agreements such as SaaS agreements or cloud services agreement, maintenance contracts, opensource licensing, hosting contracts etc…
